Terms of Service

1. Description of Service

PocketClaw provides a persistent personal AI assistant that runs in a dedicated cloud virtual machine (VM). The Service includes:

• A mobile application for managing your agent's lifecycle (spawn, wake, stop, destroy).
• An in-app chat interface for conversing with your agent.
• An optional Telegram bot integration for messaging your agent.
• AI processing powered by large language models routed by tier (Gemini for Pro, Kimi for Ultra).
• Persistent agent memory and a workspace volume on the VM.

2. Eligibility

You must be at least 17 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

• You must provide a valid email address and create a password (or use a supported third-party sign-in provider).
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.
• One account per person. One active PocketClaw agent per account.

4. Subscription Plans & Billing

4.1 Plans

Plan details, pricing, and resource allocations may change. We will notify you of material changes before your next billing cycle.

4.2 Billing

• Subscriptions are billed monthly through the Apple App Store or Google Play Store.
• Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period.
• Cancellation takes effect at the end of the current billing period. You retain access until then.
• Refunds are handled by Apple or Google according to their respective refund policies.

4.3 Free Trial

New Pro subscribers may be eligible for a free trial period. Trial length and availability are shown at the time of purchase. Trials auto-convert to a paid subscription unless cancelled before the trial ends. One free trial per account.

5. Acceptable Use

You agree not to use the Service to:

1. Violate any applicable law or regulation.
2. Generate, store, or distribute illegal content, including child sexual abuse material.
3. Harass, threaten, or impersonate any person.
4. Send spam, phishing messages, or unsolicited communications via your agent or Telegram bot.
5. Attempt to gain unauthorized access to other users' agents, data, or infrastructure.
6. Use the VM for cryptocurrency mining, denial-of-service attacks, port scanning, or other abusive network activity.
7. Circumvent rate limits, subscription restrictions, or other technical controls.
8. Reverse-engineer, decompile, or extract the source code of the Service (except as permitted by law).
9. Resell, sublicense, or provide the Service to third parties without our written permission.
10. Use the AI agent to generate content that violates applicable provider policies or platform terms.

We reserve the right to suspend or terminate your account and destroy your PocketClaw if you violate these terms. Violations involving illegal activity may be reported to law enforcement.

6. VM Resource Limits & Fair Use

• Each PocketClaw runs in an isolated VM with resources determined by your plan tier.
• VMs may be automatically stopped after a period of inactivity to conserve resources.
• Persistent storage is limited to the allocation for your plan. Data exceeding the limit may prevent your agent from functioning correctly.
• AI request limits are enforced daily. Exceeding your daily limit results in a temporary block until reset.
• Per-request output token caps are enforced by plan tier to protect service stability and abuse resistance.
• We may impose additional rate limits or resource restrictions to protect service stability.

7. Your Content & Data

• You retain ownership of all content you create, upload, or generate through the Service (“Your Content”).
• You grant us a limited license to process, store, and transmit Your Content solely to provide the Service.
• We do not use Your Content to train AI models. Conversation data may be processed by Google (Gemini) or Moonshot (Kimi) according to their provider policies.
• You are responsible for backing up any critical data stored on your PocketClaw's workspace. Destroying a PocketClaw permanently deletes all data on its volume.

8. AI-Generated Content

• AI-generated responses may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and using AI output.
• The Service is not a substitute for professional advice (legal, medical, financial, or otherwise).
• We do not guarantee the availability, quality, or suitability of any AI model. Model providers may change capabilities, policies, or availability at any time.

9. Telegram Integration

• The Telegram bot integration is optional and requires you to create your own bot via Telegram's @BotFather.
• You are responsible for your Telegram bot and any messages it sends. You must comply with Telegram's Terms of Service.
• We encrypt your Telegram bot token at rest but cannot guarantee the security of messages in transit through Telegram's infrastructure.

10. Credential Security

• Sensitive credentials (Telegram tokens, gateway tokens) are encrypted at rest using AES-256 authenticated encryption.
• You are responsible for keeping your device secure. Tokens stored on your device are protected by the operating system's secure storage (iOS Keychain / Android Keystore).
• If you suspect your gateway token or Telegram bot token has been compromised, destroy and re-spawn your PocketClaw to rotate credentials.

11. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• The Service depends on third-party infrastructure (Fly.io, Supabase, Google, Moonshot). Outages at these providers may affect the Service.
• We may perform maintenance, updates, or modifications that temporarily affect availability.
• We are not liable for any downtime, data loss, or service disruption.

12. Termination

• By you — You may cancel your subscription and destroy your PocketClaw at any time through the App. You may also delete your account in-app from Settings → Delete Account.
• By us — We may suspend or terminate your account for violation of these Terms, non-payment, or extended inactivity (90+ days with no active subscription). We will attempt to notify you before termination when practical.
• Effect of termination — Upon termination, your PocketClaw and all associated data (VM, workspace, memory) will be permanently deleted. Account data is deleted after an in-app account deletion request completes.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKETCLAW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless PocketClaw, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California. You waive any objection to jurisdiction or venue in these courts.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
